Civil Process

The Civil Process Service Division is mandated to serve all papers directed to it  by the court.  Civil Process consist of Subpoenas, Evictions, Garnishments, Divorce Papers, Small Claims, Writs, Executions, Protection from Abuse Orders and various other Civil Process.  Most of these documents must be served in a timely manner and will in many cases require a response from the defendant back to the court.  We strive to serve all papers in the most efficient and professional matter.  Orders of Protection from Abuse are priority.

*ACT 2025-420 went into effect October 1, 2025. This requires a service of process fee of $50.00. The Fee will be assessed per case, for each party requiring personal service by the sheriff in Marion County in the Criminal and Civil Division of the Circuit and District Court. This will apply to new cases, garnishments, subpoenas, summons and complaints, and IWO's. This includes CV, DV, SM, DR, CC, DC and Traffic jurisdictions. The CS and JU cases do not apply. These fees are to be paid up front when filing the paperwork to be served by the sheriff. We ask that payment be sent in the following forms: a check from the Circuit Clerk, a check from the attorney's office or a money order from the individual made out to the Marion County Commission. No personal checks will be accepted.
